These terms and conditions ("Terms") govern the access, browsing and use of the Website by the users ("User" or "Users", as applicable, or "you"), as well as the services provided through the Website in connection with AI content generation, face generation, body generation, face swapping, video creation, content transformation, and social media automation ("Services").

By accessing and using the Website, you fully accept and agree to be bound by these Terms. We may modify these Terms from time to time. In such a case, we will provide a notice to you by publishing the most current version. Through the Services, the User may upload images, provide text prompts, and use various AI-powered tools to generate, edit, transform, and enhance content including:

The User may upload illustrations, graphic designs, photographs and any other type of images, in any format allowed by the Website from time to time ("Input"), so that they can be edited, generated, enhanced and/or transformed through our AI-powered tools according to the User's instructions or prompts entered into the Service ("Output").

3. Registration and Account

To use the Services, you must register and create an account on the Website ("Account") by signing in with your email account or social media account, as allowed by the Website from time to time. Important: the User must be 18 years of age or older.

The User undertakes to provide all the mandatory information required for the registration and also acknowledges that such information is authentic, truthful, and up to date. Should the User provide false, outdated or incomplete information, or should Afluence have reasons to suspect that registration is fraudulent, Afluence reserves the right to suspend or cancel the User's Account.

By registering, the User undertakes to:

Use the Account responsibly and maintain its security
Not allow third parties to access their Account
Immediately inform Afluence if they suspect unauthorized access
Accept full responsibility for all activities conducted through their Account

4. Acceptable Use

The User agrees to access and use the Services only in accordance with these Terms and in good faith, and not to use the Services negligently or to perform or suggest activities prohibited by law or that violate the rights of third parties.

By way of example and without limitation, it is prohibited to use the Services for:

Purposes that are unlawful, misleading, false, deceptive, harmful, threatening, abusive, harassing, or defamatory
Creating content involving nudity, pornography, or obscene material
Generating content that violates intellectual property rights of third parties
Creating deepfakes or misleading content without proper disclosure
Impersonating real individuals without consent
Generating content for spam, phishing, or fraudulent activities
Creating content that promotes violence, hatred, or discrimination
Attempting to reverse engineer, hack, or compromise the security of our systems

5. Subscription and Payment

The Services are subject to remuneration as provided on the Website. To enjoy the Services, the User shall need to purchase a subscription ("Subscription"), with usage limits and features that vary by plan.

Prices include VAT or indirect taxes applicable to Services, unless otherwise stated. Afluence reserves the right to modify the prices applicable to the Services at any time before any purchase. Such modifications will be published on the Website.

Payment will be made by the means of payment accepted on the Website. Afluence uses secure payment gateways and does not store complete payment card information.

Subscriptions will automatically renew for successive periods until cancelled by the User through their Account settings.

6. Usage Limits and Fair Use

Each subscription plan includes specific usage limits for different types of content generation. Users will be informed of the usage requirements before confirming any generation request.

Credit Deduction Policy: Credits will be deducted from your allocated usage regardless of whether the AI generation succeeds or fails. This includes cases where the generation process encounters technical errors, produces unsatisfactory results, or fails to complete due to system limitations. By using our services, you acknowledge and accept that credit consumption occurs upon initiation of the generation process.

Unused monthly allowances do not roll over to the next billing period. Usage limits are automatically replenished when the subscription renews.

7. Intellectual Property

7.1 Afluence's Intellectual Property

The elements, functionalities and utilities integrated within the Services and the Website, including any content and material regarding the same, are owned by or licensed to Afluence and are protected by intellectual property laws.

7.2 User-Generated Content

Users retain ownership of their original Input content. However, by using our Services, Users grant Afluence a limited license to process, store, and transform their Input for the purpose of providing the Services.

Generated Output content may incorporate elements derived from AI training data. Users are responsible for ensuring their use of Output content complies with applicable laws and does not infringe on third-party rights.

8. Privacy and Data Protection

The collection and use of personal data is governed by our Privacy Policy, which forms an integral part of these Terms. By using our Services, you consent to the collection and use of information in accordance with our Privacy Policy.

9. Disclaimers and Limitations

Afluence provides the Services "as is" and makes no warranties regarding the accuracy, reliability, or suitability of generated content. Users are solely responsible for reviewing and validating all Output before use.

Afluence shall not be liable for any damages arising from the use of the Services, including but not limited to direct, indirect, incidental, or consequential damages.

10. Termination

Users may cancel their subscription at any time through their Account settings. Afluence reserves the right to suspend or terminate accounts for violations of these Terms.

Upon termination, Users' access to the Services will cease, though previously generated content may remain accessible for a limited period as specified in our data retention policy.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
